A formal warning released by the Phuket Provincial Land Office has cautioned property owners that lettings under 30 days are not permitted.
Thailand’s largest island is a popular holiday destination both internationally and for residents of Thailand. Phuket offers a range of accommodation to cater for every budget, but short term rentals are in the spotlight in an attempt to protect hoteliers.
Property owners cannot reap the benefits of renting their property under similar terms than that of a hotel according to the Hotel Act 2004. A common practice in many cities across the world including London where local governments are conscious of the hotel trade suffering from short term lettings that are typically used as serviced apartments or for users of online marketplaces such as Air bnb.
Only time will tell if this is a stern warning or whether action will take place for owners in breach of the terms. However, the message is clear that owners are being advised to register their properties as a hotel to avoid being accused of running an illegal hotel that could result in a fine of THB 20,000 or up to one year in prison, or both.
